Criminal Defence in a large conspiracy to murder case resulting in acquittal: R-v-J

24/06/2009

J was tried at court for 13 weeks for his part in a complicated conspiracy to murder a gang member. He was acquitted as a result of the work done by David Phillips and Partners criminal solicitors.

Following the shooting of a gang member outside a prison, J and 10 others were charged with conspiracy to murder. The prosecution alleged that J provided the firearm to a 15 year old boy who was to carry out the execution-style killing. Given the severe nature of these allegations 6 of the 11 accused were represented by Queens Counsel and a junior advocate.

The Crown prosecutors relied on evidence obtained from previous court hearings, intelligence reports and other potential “hearsay” documents to establish gang membership and the role of each of the 11 defendants in the gang.

J instructed David Phillips and Partners’ criminal solicitors to defend him. We made extensive enquiries as to his movements and sought additional disclosure of evidence from the prosecution as a result of our investigations.

Although the prosecution were under heavy pressure to secure a conviction due to the publicity the case attracted, David Phillips and Partners criminal solicitors were successful in securing a ‘not guilty’ verdict for J after the long trial.
