Actions against the police claim for wrongful arrest, false imprisonment, police assault and malicious prosecution: K.O.-v-Chief Constable of Merseyside Police (“CCMP”)

K.O. asked David Phillips and Partners solicitors to pursue his actions against the police claim for wrongful arrest, false imprisonment, police assault and malicious prosecution against CCMP following his arrest for being drunk and disorderly. CCMP denied liability but settled his compensation claim for substantial damages 4 days before trial.
K.O. was arrested for being drunk and disorderly and assaulted by the police on his way to the police station. He refused to accept the caution offered by the police and was charged with an offence of being drunk and disorderly.
He subsequently agreed to a bound over for one year, but instructed David Phillips and Partners solicitors to pursue an action for wrongful arrest, false imprisonment, police assault and malicious prosecution.
We submitted K.O.’s claim to CCMP, who denied liability. On David Phillips and Partners solicitors’ advice, proceedings were issued. A defence was filed and the case proceeded to a full trial. 4 days before trial CCMP settled K.O.’s claim for £5,000 plus full legal costs.
