Actions against the police claim for police misconduct and malicious prosecution: J.J.-v-Chief Constable of Merseyside Police (“CCMP”)

24/06/2009

J.J. was acquitted following a trial for being drunk and disorderly. Despite the police denying liability throughout, David Phillips and Partners solicitors secured a substantial damages award for him for his action against the police compensation claim.

J.J. was arrested for drunk and disorderly behaviour after he called the police to his home to complain about the conduct of another person. The police took him to the station in nothing more than his underpants.

J.J. complained about the police misconduct on his arrival at the station but was ignored. Instead, he was given a paper suit and charged with drunk and disorderly behaviour before being released.

He was acquitted of all charges at court.

J.J. contacted David Phillips and Partners solicitorsactions against the police team. We advised him to pursue a claim for police misconduct. Proceedings were issued but CCMP denied any wrongdoing. Shortly before trial  CCMP settled J.J.’s actions against the police compensation claim. He received £11,250 plus full legal costs.
